This is an appeal by the Commonwealth from an order of the court below denying a petition to extend the time for commencement of trial and discharging the appellee. The court below predicated its order upon a finding that the appellees right to a speedy trial under Pa.R.Crim.P. 1100 had been violated. For the reasons stated herein, we reverse the order of the lower court, reinstate the criminal charge against the appellee, and remand the case to the court below for trial within one hundred and twenty (120) days.
